Terms of Service

These Terms of Service govern your access to and use of dumbledor (dumbledor.com) and related services, provided by netchase UG (haftungsbeschränkt). By creating an account or using the service, you agree to these terms.

1. Scope and contracting party

The contractual partner is netchase UG (haftungsbeschränkt). These terms apply to business customers and consumers. If you are a consumer within the meaning of § 13 BGB, mandatory statutory consumer rights remain unaffected. Where a provision would limit such rights, it does not apply to you as a consumer.

2. The service

dumbledor provides hosted analytics, dashboards, APIs, uptime monitoring, and related tooling. Features, limits, and availability may change as we improve the product. The main characteristics of each plan are shown on our pricing page and in your workspace before checkout.

3. Accounts and security

You are responsible for your account credentials, workspace access, and all activity under your account. Notify us promptly if you suspect unauthorized access.

4. Acceptable use

• Do not use the service for unlawful, harmful, or abusive activity.
• Do not attempt to disrupt, probe, or reverse engineer the platform except as permitted by law.
• Do not collect or process personal data without appropriate legal basis and notice to end users.
• Respect rate limits, API rules, and plan-specific restrictions.

5. Customer data

You retain ownership of data you submit to the service. You grant us the rights needed to host, process, and display that data to provide the service. You are responsible for the accuracy and legality of data you send through trackers, APIs, or integrations.

6. Plans, billing, and taxes

Paid plans, usage limits, and overage charges are described on our pricing page, at checkout, and in your workspace billing settings. Prices are shown before you place an order. Fees are billed monthly in advance or in arrears according to your plan. Applicable taxes (including VAT where required) are shown at checkout. Subscriptions renew until canceled through the billing portal.

Payment processing is handled by our payment provider (Polar). Their terms may apply to payment transactions in addition to these terms.

7. Right of withdrawal (consumers)

If you are a consumer, you have a statutory right to withdraw from paid subscription contracts within fourteen (14) days. Details, exceptions, and the model withdrawal form are set out in our Right of Withdrawal page (Widerrufsbelehrung).

By starting a paid subscription and confirming at checkout that you request immediate access, you agree that performance begins during the withdrawal period and acknowledge the conditions under which your withdrawal right may expire early, as described in the withdrawal policy.

8. Availability and support

We aim for high availability but do not guarantee uninterrupted service where such a guarantee is not mandatory by law. Maintenance, outages, and third-party dependencies may affect uptime. Support scope depends on your plan.

9. Intellectual property

dumbledor, its branding, software, and documentation remain our property or that of our licensors. These terms do not grant you rights to our trademarks or source code except as needed to use the service.

10. Warranty and liability

For consumers, statutory warranty rights for digital services under German law apply. We are liable without limitation for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit), for injury to life, body, or health, and under the Product Liability Act (Produkthaftungsgesetz).

In cases of slight negligence, we are liable only for breach of essential contractual obligations (Kardinalpflichten), and only for foreseeable, typical damage. Essential obligations are those whose fulfilment makes proper performance of the contract possible and on which you may regularly rely.

For business customers, liability for slight negligence is excluded except for essential contractual obligations as described above. To the extent permitted by law for business customers, our total liability for claims arising from or related to the service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages where exclusion is permitted by law.

11. Termination

You may stop using the service at any time and cancel paid subscriptions through the billing portal. We may suspend or terminate access if you violate these terms, create risk for other users, or as required by law. Upon termination, your right to use the service ends, subject to any data export options available in your plan.

12. Governing law

These terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in the EU, you also retain mandatory protections of the laws of your country of residence where applicable.

13. Changes

We may update these terms from time to time. Material changes will be communicated through the product or by email. For consumers, changes that reduce statutory rights require your express consent. Continued use after other changes become effective constitutes acceptance where permitted by law.
